Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Audio Monk ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Mars Venture Labs LLC ("we," "us," or "our").

2. Description of Service

Audio Monk is a mobile application that turns books, PDFs, documents (including EPUB and other e-book formats), and photographed pages into podcast-style narrated audio. Features include:

• Importing documents or scanning printed pages with the camera
• AI-generated narration with two conversational hosts or a single narrator
• A built-in library of free, public-domain books you can browse and listen to
• A personal library that remembers your books and listening progress
• Offline playback of audio you have already generated
• Optional iCloud backup of your library
• Optional daily listening reminders

The App is free to use and is supported by advertising on the free tier; an optional Premium subscription removes ads and unlocks additional features (see Sections 7 and 8).

3. No Account Required

Audio Monk does not require you to create an account. Your library, generated audio, and progress are stored on your device and, if you enable it, in your own private iCloud. You are responsible for maintaining the security of your device and your Apple ID. We do not operate user accounts and do not store your library on our servers.

4. Eligibility

You must be at least 13 years of age to use Audio Monk. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or guardian to use the App.

5. Your Content and Responsibilities

You retain all ownership of the documents, books, and pages you add to the App ("Your Content"). We do not claim ownership of Your Content. The App processes Your Content only to generate narration for you, as described in our Privacy Policy.

You are solely responsible for Your Content and for ensuring you have the necessary rights to use it. You agree that you will only import or scan material that you own or are otherwise legally authorized to reproduce and convert to audio. You must not use the App to process content in a way that infringes the copyright or other rights of any third party.

Free Public-Domain Books

The App includes a library of books that are in the public domain (works whose copyright has expired), sourced from public collections such as Project Gutenberg. These works are provided for your personal, non-commercial listening on an "as is" basis. Public-domain status can vary by country, and you are responsible for ensuring a given work is in the public domain in your jurisdiction before use. Audio Monk and Mars Venture Labs LLC are not affiliated with, and are not endorsed by, any author, publisher, estate, or the sources from which these works are obtained, and the AI narration is our own generated interpretation of the underlying public-domain text.

6. AI-Generated Narration

The narration produced by the App is generated by automated artificial intelligence systems and text-to-speech technology. While we strive for quality, AI-generated narration may contain inaccuracies, omissions, mispronunciations, paraphrasing, or other errors, and may not perfectly reflect the source material. The narration is provided for convenience and personal listening only and should not be relied upon as a substitute for the original work or as professional, legal, medical, or financial advice.

7. Free and Premium Tiers

Audio Monk is free to download and use with core features. The free tier is supported by advertising, including rewarded video ads that you may choose to watch to unlock additional listening. The App also offers an optional Premium subscription that may unlock additional benefits, such as:

• An ad-free experience
• A higher daily page allowance for generating narration
• Add as many books, PDFs, and scans to your library as you like
• The full selection of narration voices
• Offline downloads and other premium features

Some capacity limits (such as a daily limit on the number of pages that can be generated) may apply even to Premium in order to keep the service reliable. Specific Premium benefits, limits, and any free-trial terms are shown in the App at the time of purchase.

8. Subscriptions and Billing

Premium is offered as an auto-renewable subscription (for example, Monthly and Yearly plans). The exact price, billing period, and any free trial are displayed in the App and the App Store before you purchase.

Prices may vary by region. Actual prices will be displayed in your local currency in the App Store.

Subscription Terms

• Payment will be charged to your Apple Account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription in your App Store Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of your next subscription period following the change. Your continued use of Premium after a price change becomes effective constitutes your agreement to the changed amount.

9. Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple in accordance with their refund policy. We do not have the ability to process refunds directly.

To request a refund from Apple:

• Select the purchase and follow the instructions

10. Acceptable Use

You agree to use Audio Monk only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Use the App to reproduce or distribute content you are not authorized to use
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels on the App
• Interfere with the proper functioning of the App or attempt to overload our service providers
• Attempt to manipulate or circumvent subscription checks

11. Third-Party Services

To generate narration, the App relies on third-party AI and text-to-speech providers (including Cloudflare, DeepInfra, and Microsoft). The free tier uses third-party advertising and measurement services (including Google AdMob, Google Analytics for Firebase, Meta, and TikTok). The App also uses Apple services for distribution, payments, notifications, and (if enabled) iCloud storage. Your use of these features is also subject to those providers' terms, and their handling of data is described in our Privacy Policy. We do not guarantee the continuous availability of any third-party service, and features that depend on them may change or be interrupted.

12. Intellectual Property

The App, including its original content, features, functionality, design, and branding, is owned by Mars Venture Labs LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• AI-generated narration will be accurate, complete, or suitable for any purpose

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARS VENTURE LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

• Your use of or inability to use the App
• Any errors or inaccuracies in AI-generated narration
• Any loss of locally stored or backed-up library data
• Any bugs, viruses, or harmful code transmitted through the App

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Mars Venture Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, your violation of any rights of another, or the content you import or process through the App.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.

18. Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Bozeman, Montana. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mars Venture Labs LLC regarding the use of the App and supersede all prior agreements.
