1. Acceptance of Terms

By downloading, installing, or using Back Pain Relief ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legal agreement between you and Mars Venture Labs LLC ("we," "us," or "our").

2. Description of Service

Back Pain Relief is a mobile wellness application that provides personalised back pain exercise programmes. The App provides features including:

• Interactive pain zone selection across 9 body regions
• AI-generated personalised weekly exercise plans
• Guided exercise sessions with timers, audio instructions, and GIF demonstrations
• Progress tracking, streaks, and pain improvement charts
• Daily reminders and push notifications
• Pre- and post-workout pain severity ratings

The exercises and information in this App are not a substitute for professional medical advice. Always consult a qualified healthcare provider before starting any new exercise programme, particularly if you have a pre-existing medical condition or injury.

3. User Accounts

To use Back Pain Relief, you must create an account using:

• Email address and password, or
• Google Sign-In

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete registration information
• Notifying us immediately of any unauthorised account access

Your workout data and progress are stored securely in the cloud, allowing synchronisation across devices.

4. User Eligibility

You must be at least 13 years of age to use Back Pain Relief. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or guardian to use the App.

5. Subscription Plans and Features

Free Tier

Back Pain Relief is available for free with access to core features, including a personalised exercise plan and guided workout sessions.

Premium Subscription

A premium subscription unlocks additional features including enhanced exercise libraries, advanced progress analytics, and an ad-free experience. Subscription options include weekly, monthly, and yearly billing periods.

Prices are shown in the Google Play Store in your local currency and may vary by region.

6. Subscriptions and Billing

Back Pain Relief offers optional premium subscriptions processed through the Google Play Store.

Subscription Terms

• Payment will be charged to your Google Play account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription in your Google Play Account Settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

Price Changes

We reserve the right to change subscription prices. Price changes will take effect at the start of your next subscription period. Your continued use of the App after the price change becomes effective constitutes your agreement to pay the changed amount.

7. Refunds

All purchases are processed through the Google Play Store. Refund requests must be submitted directly to Google in accordance with their refund policy. We do not have the ability to process refunds directly.

To request a refund from Google:

• Visit play.google.com/store/account/subscriptions
• Sign in with your Google account
• Select the subscription and follow the instructions

8. Acceptable Use

You agree to use Back Pain Relief only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates applicable laws or regulations
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels on the App
• Use the App to transmit harmful, offensive, or illegal content
• Interfere with the proper functioning of the App or its servers
• Create multiple accounts or share account credentials
• Attempt to circumvent subscription checks or in-app purchase verification

9. Health and Safety

By using Back Pain Relief, you acknowledge and agree that:

• You are participating in physical exercise activities at your own risk
• You will stop exercising immediately if you experience sharp pain, dizziness, shortness of breath, or any other concerning symptoms
• You will consult a healthcare professional before starting the programme if you have any pre-existing conditions, injuries, or medical concerns
• The App is not a substitute for professional physiotherapy, medical treatment, or healthcare advice
• Results from using the App may vary and are not guaranteed

Mars Venture Labs LLC shall not be liable for any injury or health consequence arising from your use of the App's exercise programmes.

10. User Content

You retain ownership of any data you input into the App (pain ratings, feedback, preferences, etc.). By using the App, you grant us a limited licence to store and process your content as necessary to provide the service, including generating and adapting your personalised exercise plan.

11. Intellectual Property

The App, including its original content, features, functionality, design, exercise database, audio content, and branding, is owned by Mars Venture Labs LLC and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

12. Account Termination

You may delete your account at any time through the App settings. Account deletion will:

• Remove your profile and workout data from our servers
• Not automatically cancel active subscriptions (manage in Google Play settings)

We reserve the right to suspend or terminate your account at any time, without prior notice, for conduct that we believe violates these Terms, is harmful to other users or us, or for any other reason at our sole discretion.

13. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements or expectations
• The exercise programmes will produce specific health outcomes

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARS VENTURE LABS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any physical injury or health consequence arising from following the exercise programmes
• Any unauthorised access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, or other harmful code that may be transmitted to or through the App
• Any errors or omissions in any content
• Loss of workout data or progress records

In no event shall our total liability exceed the amount you paid for the App in the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Mars Venture Labs LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another
• Any injury or harm resulting from your participation in exercise activities

16. Medical Disclaimer

BACK PAIN RELIEF IS A WELLNESS APP ONLY. IT IS NOT A MEDICAL DEVICE AND DOES NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE CONTENT AND EXERCISE PROGRAMMES PROVIDED ARE FOR GENERAL INFORMATIONAL AND WELLNESS PURPOSES ONLY.

ALWAYS SEEK THE ADVICE OF YOUR PHYSICIAN, PHYSIOTHERAPIST, OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION OR EXERCISE PROGRAMME. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY IN SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ OR DONE IN THIS APP.

IF YOU EXPERIENCE SHARP PAIN, NUMBNESS, TINGLING, DIZZINESS, SHORTNESS OF BREATH, OR ANY OTHER CONCERNING SYMPTOM DURING EXERCISE, STOP IMMEDIATELY AND SEEK MEDICAL ATTENTION.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website and updating the "Last updated" date. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Montana, United States, without regard to its conflict of law provisions.

19. Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Bozeman, Montana.

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

20. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mars Venture Labs LLC regarding the use of the App and supersede all prior agreements.
